Wyndham Lawsuits and Legal Actions

Following are several links to Wyndham-related lawsuits on behalf of owners.  Many of these are against Wyndham’s other brands or subsidiaries (Trendwest, WorldMark, RCI, etc.):

Here is a link to the RCI Class Action Settlement Agreement, dated Nov 21, 2008, which finds Wyndham subsidiary company, RCI, to have used timeshares deposited with them for exchange, and rented them to the public without knowledge or approval of owners.  Said deposits were rented to the public for Wyndham’s own corporate benefit and once removed from inventory, were no longer available for other owners to receive in exchange.

Here is a link to a Dec 10, 2008 finding against Wyndham to allow Worldmark (another Wyndham membership program, similar to FairShare) owners’ access to the email addresses so proxies may be sent to owners to try and overthrow their Wyndham-controlled Board of Directors.  It is item 8 in the list.  Also notice the part where the Board of Directors tried to amend their bylaws to disallow this, even while the complaint and petition were pending!

Here is a link to the pending class action suit against Wyndham for monopolizing the Board of Directors of WorldMark and devaluing their ownership.  This is a different membership program than FairShare, but the premises of the class action are very similar.

Actually, the website http://whatswrongwithwyndham.com has much more information about the Worldmark class action suit and should prove helpful in understanding how Wyndham is trying to use their corporate relationships to manipulate the various organizations they are entrusted to manage.

Here's another recent example. In December, 2008, the Property Owner's Association at Daytona Beach Ocean Walk, which was managed by Wyndham, filed the largest civil suit in Florida’s history (against Wyndham), again alleging misuse of the resources the were supposed to manage, misuse of funds, and unwillingness to relinquish assets even after being fired as the management company.

Additionally, there are several State Attorney General’s who have taken punitive action on behalf of their constituents against the timeshare industry, mostly for unfair sales and marketing practices.  Here are four examples (one involving Wyndham subsidiary, Worldmark):

California Attorney General Bill Lockyer sues Trendwest (a former Cendant subsidiary).

Missouri Attorney General Jay Nixon sues Branson timeshare developer.  Notice paragraph four, which alleges that specified promised benefits were not delivered.  This is one of the biggest concerns owners have with what Wyndham is doing to their owners.

Here’s another lawsuit filed by Missouri Attorney General Jay Nixon last year – this time against Festiva Resorts.

Pennsylvania Attorney General Tom Corbett announced lawsuits against multiple Florida timeshare companies for deceptive timeshare practices.  Everything Wyndham is currently doing to our ownership would certainly fall under the title of “deceptive” (or worse).

I have sent cease and desist letters and still get at least 2 recorded messages every day! They used unfair sales practices, were deceptive and now I have a loan for 19.99% and am in debt over $96,000. I am battling breast cancer, huge stress, and husband has recently been diagnosed with cancer, too. We can't afford the "emperors' new clothes" HELP ME PLEASE

    8. I'm a wyndham owner and former timeshare salesperson in south Florida.I can confirm that Wyndham is a criminal organization that teaches it's employees to deliberately confuse and misleadv you into buying at these presentations.
If you really don"t want timeshare DO NOT go to the presentation and DO NOT just go and waste hours of your vacation for the stupid gift. Here"s 2 ways to own timeshare which in its simplest form is a great product and money saver VS hundreds of dollars per night for a tiny hotel room.
      1) Go on EBAY,Craigs List,Etc and buy the timeshare resale for pennies on the dollar direct from the owner. You can find 300,000 to 400,000 point packages for hundreds of dollars instead of the tens of thousands of dollars that Wyndham rips you off for. Just be sure to call Wyndham and make sure to get an Estoppell letter showing that all money owed, maintenance etc is up to date, and the deed is clear before you buy.Don"t listen to their bullshit that you won"t qualify for VIP benefits,as you usually won't need them anyway.
Or buy 2 deeded RCI weeks the same way, from the owner .Preferrably 3br red weeks as these are most valuable.
Then use Wyndham"s PIC Program to turn these weeks into Wyndham points on a yearly optional basis. You need to purchase some Wyndham points to do this but for a purchase of about $12-15K or about 120,000 points you can trade in your 2 -RCI 3br red weeks for 254,000 points each which will give you over 600,000 points and Gold VIP each year.Congratulations !You just beat these assholes and will never need another point! You should break even in about 5 years in which you would have spent the same money anyway.
      Good Luck

    10. We bought shares through ebay and the transactions went smoothly. We have loads of points and take vacations when needed. We are constantly told that we don't qualify for VP status, which is fine. However, were received a deceptive letter saying that we were part of a lawsuit that had been settled, as part of that settlement, and to avoid any repercussion from the lawsuit, they want us to turn over our resell deed to them. So basically, for resell points, they are scamming people to just automatically turn over their points for no reason but to their benefit!

    11. I would rather go through another divorce than deal with the hell that I have been through with my time share. I have tried for years to accept that I am paying $1000 in maintenance dues for something I don't even use. I have tried to get out to find that it will cost thousands. I have long since past the point of thinking I will get anything out of this. I was hopeful that I could change my attitude and force my family to use the damn thing. I just got my daughter's hopes up that she could spend a weekend (nobody has a whole week) in park city at a two bedroom exchange. Then I discovered the exchange fee was $300. What the hell is the point? She could just book it herself for that. I am so fed up. So angry. So sick and tired. I want out so bad I am screaming at the black binder I got from Mystic Dunes, who by the way is on the "do not accept" list for buy backs in another vacation club that we were hopeful would take the waste of life off our hands. So done. Please God, please someone. I did not expect to be in this kind of prison by signing those papers 14 years ago. Like I said, my marriage was much easier to get out of and that hell was only 10 years long.

I ask why we have to pay maintenance fees for something we will never use....in the contract and they will ruin our credit if we default....We tried to cancel after purchasing many phone calls, emails, etc we were told we had a 10 day waiting period...after saw that we only had 7 days to cancel....Feeling stupid for falling for such a scam...Even when the loan is paid off the maintenance fees will continue...

I have tried, selling, renting even giving it away. I have tried deeding it back to the company for nothing (Vista Mirage in PS), but they don't have a program for that. It does feel like a prison. I got stuck with mine in a divorce when I was in my early 20's. I was living paycheck to paycheck but still managed to pay it off. I don't care if I get a single penny for it - I just want it GONE, GONE, GONE! My level of hatred for these folks is like acid running through me. Where are all our legislators? Obviously, with 1000's upon 1000's of people falling victim to these roaches, some kind of reform is needed.

We would join because the new rules in Wyndham go against everything the salesman told us to get to Presidential Reserve ( $$$) We were told to cancel/rebook/ upgrade at 60 days out to get our reservations at 1/2 the points. Now, we are told that was a "glitch" in the system. We can no longer do that and it was marketed to us that we could. We would have never upgraded if we'd known their bait and switch tactics!!!

    19. Count me in. Wyndham has abandoned "owners" in favor of shareholders (themselves) by finding ways to increase profits hence share price and one of the ways they do this is to grab cancelled reservations and ship them off to online rental companies (Booking.com for example which has an exclusive relationship with Wyndham. I tried to list one of my units on Booking and was told they could not do it because of their agreement with Wyndham). Not only are we denied the "re-book/discount" value of what was sold to us but we are denied access to inventory that could otherwise be available to us for new reservations. Sue, yes indeed. Stand out front of their resorts that sell their product and picket, yes to that as well.

    20. We want to join a class action lawsuit against Wyndham. They are defrauding us by taking away the "rebook/discount" cutting our point value and vacation time in half. Also we travel with our 3 daughters and their families. It seems we can no longer book multiple units. We have over 1,000,000 points, and they are becoming useless to us!

    21. I would like to join a class action lawsuit also against Wyndham. Since March, they have talked us three time into purchasing more points saying we were in the wrong program. We are now in debt for $96,000 plus $600 maintenance fees monthly. My husband is 70 and retired and I am 69 and was looking forward to retiring at 70. Those dreams are gone. I had to remortgage our home and max out all of our credit cards. My husband and I are both ashamed of how we could have been talked into all this but the pressure is so great. I feel like we have sucker written on our foreheads.

    22. My husband and I were just told to file bankruptcy by a Wyndham employee, that do not have programs to help their timeshare owners with reducing their payments. We are currently paying $1,500.00 a month which is more than our house payment. I can NOT believe what that employee told me to do…bankruptcy!!! Is there still talk about a class action law suit? Count us in. The way they trick, lie, deceive, bad cop - good cop tactics is wrong on every level. My husband and I thought we were doing a good thing buying into a timeshare…were really looking forward to taking advantage of it once we retired, but not anymore. Please let me know if anyone has or is ready to take action against these monsters.

    1. We have a crumby 84,500 points in the winter in Nashville. We bought them because we were told that we could swap them with a fee for a vacation anywhere in the US. We wanted to go to Southwest Florida, but have never been able to use those points in Southwest Florida. I am an attorney, and I am considering suing then Fairfield, now Wyndham. We have been switched from weeks to points, even though I still have a deed of trust. I'm afraid that after I do the discovery I'll find that everything has been pilfered. I will cost me a lot of time, but I'm going to do it. If this NO timeshare fella has a case against Fairfield/Wyndham, or against Nashville, I will gladly pay his fee and then go after them.

    2. We should all go sign a new contract after their lengthy sales pitch and file suit using video recording of the deceptive practices then when everyone from all the different resorts shows the same practices on video they won't be able to deny using these practices in their training.

    6. Previous caller employeeFebruary 22, 2017 at 8:06 AM

I am personally not a timeshare owner although, I did work at one of the call centers (or should I call them little crammed cubical back offices) that books reservations for these crooks. They call current owners, owners who haven't owned in over 20-30 years, families of deceased owners, or people who don't even own one and never had anything to do with one. They dont know who they are calling for specifically since it's an auto dial out thats why they always say, "may i speak with Mr. or mrs." When I was first hired on the job the manager made it seem like we were setting up reservations for actual updates for specific timeshares and the owners knew they needed to attend but no its just more sale pitches to screw more owners over. So not only some timeshares as a whole is a scam so are the jobs. I never knew what a timeshare was until I worked here and the people I spoke to about it before taking the job hyped it up so I didn't think anything bad was going to come from it. As I grew with the company the more I realized that this was heartless and basically harassment. If you EVER get a call from someone reserving a dinner spot for you at a timeshare meeting DO NOT GO! And if you don't want them to continously call you threaten to call the FCC, BBB, or threaten to take legal action. The callers BY LAW MUST put you on the national and universal Do not call list if you do that because they know what they are doing is harassment but if you're blinded by it and don't know what you can do they'll continue. I no longer work there but be aware this entire industry is it's own kind of hell

  6. We purchased what we thought were UDI points. We were told upfront they were converted from a fixed week but they were now fixed week points We were assessed a higher than normal assessment because Wyndham UDI points were exempt but fixed converted to UDI were not so we bore the brunt of the burden. Requests for paperwork have been met with stall tactics.

This is just a bad company. Everyone at Wyndham tells you it is someone else's fault but never do they own up to their actions.

  7. Is there a class action lawsuit that I can take part in currently? I'm so fed up with the way Wyndham treats their fairshare plus owners. It was a very tiny efficiency property. We were highly disappointed! I have tried to sell our "property" but was told that it is totally worthless! We have not received a deed for this "worthless" property yet we are still paying fees at very high interest rates. Please keep me in mind if a class action is brought against them. 10. I have been a Worldmark owner since 1999. I did use and enjoy the timeshares. In July 2012 I spent a week at the Indio, CA site. After being harassed to conduct a "survey" for a few minutes I met with a salesman. I am an older single woman and I explained to him that I was unemployed and could not afford nor need any more shares. I told him that I intended to pay off the balance of my contract with savings to save the interest and that was all I could afford. He became very aggressive and brought his manager to sit with us. They both told me that if I would just use the money to upgrade I would be eligible to exchange my share for some high end vacation spots which I could rent out and pay the bill. After hours I signed. A year and $13,000 later, I am still unemployed and have no choice to break my contract, ruining my credit and totally losing all the credits I have paid for all these years. I am just sick.

  13. Wyndham employees commit fraud, misrepresent the product, and basically are scam artists/con artists. With saying this, the entire company is based on fraud and their goal is to scam hard working honest people. I've been a Wyndham owner for approximately four years and had they not have changed their programs, I would be satisfied with "what I thought I had purchased". I am an owner of Club Wyndham Select which was to be so "prestigious" and now I find out that under the new program of Wyndham Access many of my "prestigious" benefits will be an automatic given to Wyndham Access members. I've been lied to, pushed to make another purchase, and then treated poorly once the sales representative/sales manager realizes that I know have a clear understanding on how this company works. Have you had any luck? I recently heard the word ovation via a presentation. However, I tried finding a meaning in real estate and could not find it. I am suspicious that it might have a double meaning to Wyndhan. Of course, as usual, they tell you it only works if you have something Wyndhan wants. Which means, their product sucks if they don't take it back. Interesting, that they themselves agree that their own product sucks, this should be a hint to all vacation seeking folks of the future. 14. My wife and I got behind on our maintenance fees as we moved from Germany to the U.S. We received a letter stating that we were going to forfeit our timeshare points to them permanently and have no further ownership for being 700 dollars in debt of maintenance fees. We sent a certified letter and they relented, calling and agreeing to allow us to continue ownership but instead had us forfeit our existing credits... They made no mention of us having to forfeit our credits for being in debt with maintenance fees.

We are now fully paid off with maintenance fees yet lost 12000 credits and when I called asking about it, the person said we lost the credits because we were behind on our maintenance fees and there is nothing that can be done, it was our fault for not paying our bill... Do I have any legal recourse to get my 12000 confiscated points back?

  15. .  I too have a timeshare from them and I feel I was scammed.  I was told it would increase in value (false), I could easily go through my bank to refinance since it was like a regular mortgage (false), I could bank points (was not told it would cost me more money to do so and I have a very short window to do so), was told I could transfer my points to rci to use additional resorts (not informed about the very high additional costs to do so), was given "free" rci stays to use since they took up so many hours of my vacation (not informed these were not free, rci said I had to pay them hundreds of dollars per certificate.  Thats not free).  Was invited to what I was told was a presentation for owners regarding changes to the timeshare, turned out to be a pressuring sales.  It didnt matter how much I said no and wanted to leave, they just added on the pressure until I finally made a purchase with promises to be managers and always available to assist with booking vacations, renting points, etc.  This never happened.  I ended up with emails and calls that went without a response.  Told I could get out of a deed, transfer to another one and.my rates would be lowered, this was not true.  I ended up paying even more, much more.

    > By the time, I returned from.the vacation I was on and tried to reach my "manager" the time ran out to even write the company to get out of this mess.  There were so.many other lies told regarding benefits and the referral program.  Always having to fill out a form and give names of friends and.family for them call.  I hated that part but again, the pressure they put on you (2 -3 people sitting around you in a small corner, makes you feel like small prey).
    > I know they have contacted people on my referral list and someone made a purchase and/or make a visit but Wyndham never contacted me in any way about that.  No rewards ever given either.

Was also told that for a 1 time cost of $89 our 20,000 pts with Georgian Manor would be converted to 154,000 pts with Wyndham. This would be done annually and we wouldn't have to pay any extra amount, other than the $15,000 US we paid in September...
Turns out that this is not the case and we cannot convert our RCI Points to Wyndham Points and we are now screwed out of $15,000 US. How do I go about getting the contract we just signed reversed and get my money back? Please help...

  18. I have 500K points from two of the Wyndham in Kauai, one was purchased prior to Wyndham purchasing the management contract and two after because we were not able to use their other services unless we bought more points under their program. These points were purchased with the intention of my wife and I traveling to other destinations outside of Hawaii. Three years ago my wife passed away and I am stuck with points/timeshare that I am not interested in after all "one is the loneliest number", and there is not a market for their product. In fact they cant be given away, you have to pay to pass them on to someone else. They say they have a great product and I have yet to see where their greatness is, I believe they are great in their own eyes only! I recently called in because I received a collection letter stating that I was past due on my account and my monthly maintenance fee is automatically charged by them. Go figure!

  19. Biggest scam yet! When you do a trade, Wyndham directs you to there resorts for vacancies instead of where you want to go. This is their marketing scam to keep Wyndham owners buying more and more useless Wyndham points. You cannot trade in Wyndham and not be pestered about a presentation. Why is it that Wyndham and RCI points are totally different? Just like Worldmark, same thing. Now that they have gobbled up Shell Vacations, what will their system look like? It's not the product, it's the people running the business that are the problem. Old school, the names haven't changed, just the locations of where they are working and the positions that they hold have. People blame the salesperson, ever thought maybe that salesperson has a sales manager? There is an old saying, it starts at the top! Try filing suit against those people holding them personally responsible and see if things change. A corporate Vail is only so thick.

  22. About a little over a year ago I went to see family and just get away from the troubles that was happening in my life. I didn't know my cousin was a Wyndham sales rep and the day I was supposed to drive to LA she took me to her job and wanted to show me all the nice places and just basically tried to butter me up. Not once did I go to a presentation and literally she kept me there almost the whole day. I even told her no its not for me, and called my sister, because I wasn't in a good spot, I was having trouble in my marriage, and dealing with the military, I was having health issues and was in and out of the hospital just before I went there. She took my phone and never gave it back. She made all these promises like it will help my credit, the first payment will be free which it wasn't, if I fall behind the payments is linked to her account, she would even take it for me if I didn't like it, or she'll resell it for me, I'll have equity on it, she told me they would even add to my plan of 86000 points and it will be 300000 and VIP she even told me to make profit and sale this points and that which i know nothing of how to do anyway or have the time. I thought maybe it was good come to find out those extra points once used up wont come back. Because I was military I was getting a good deal even brought other family names into it saying so and so would kill for this deal. I just wanted to get out of there. I didn't even know converting points to rewards or moving them would cost money I was told it would be free. It just wasn't a good time in my life to even think about getting this. After I signed the papers it's like all of a sudden the work was done and she was nowhere to be found. I decided to call them to cancel it but they said I would have to mail it in and by that time it would be too late to cancel without penalties. Apparently I only had a 5 day window which she told me give it 6 months and if you still don't like it don't worry I'll help you. I called my cousin and she said she would send me the paperwork. It was simple I would just sign and I would get what I put down back. When I called her again she said she'll send the paperwork if I sent her money because she had to put like 100 or so in after basically drained me for what I had when I was there and when I said I'll give you some of what I get back so I know it worked and I never heard from her again. Until this day she has ignored me and I think I even have her recorded phone call on my phone saying those things. But I just thought all the lies and she's supposed to be my own family it's just disgusting. I even read you get incentives for going to to the presentation I was told I would get 200 on an American express card and I never did they gave me dinner coupons. Which I never went to the presentation anyway so I don't care but I feel like if I did I would've been more confident on what I was getting myself into.

She was duped. This isn't a real TIMESHARE legally anyway!. We all call it that but there is no tie in into any property.. This is pre paying for hotel rooms for 10 years, NOT A TIMESHARE!!!!!!!!!! We want to walk away from this WITHOUT DINGING HER EXCELLENT CREDIT RATING. Does anyone have a great GO TO person that can shut this BS Contract down WITHOUT it costing her outrageous fees? This whole Timeshare system is really a nightmare with "ambulance chasers" out there that RIP YOU off after the First RIP OFF of buying into the Worldmark Fraud in the first place. How is it that this corporation is still in business???? I have worked in Commercial Real Estate for 8+ years now but even this is new to me. What is your cost JUST TO GET OUT OF CONTRACT?. 2. These people are terrorist and need to be treated as such! Just my opinion. But we had the same thing happen to us at The Grand Seas Resort in Daytona Beach Florida as I tried to leave they blocked the door and would not let us leave until we signed the papers, and to cover their @$$ they had us initial and sign a statement that said they never said anything that they stated during the presentation. It was like the flashy thing in MIB (you never heard us say any of these things at any time during the presentation. It is all a figment of your imagination. Sign the papers now and we will let you go) Our folly was not really paying attention to what we were signing, so I guess we are just as screwed as most of the people here.

  23. I too have a problem with timeshares. I purchased mine 25 years ago when it was great for vacationing. You could swap it for a fee of course. Now, it's not good enough to exchange somewhere else without throwing in additional weeks so you will have more points, of course it has to be all inclusive and so far I have had no luck exchanging it at all because my resort where I purchased no longer can compete with all the new resorts but you can't exchange it because your unit is not good enough or powerful enough to exchange. So, now I am stuck with it, no one wants it. I have even tried to give it away. I can't exchange it. I have lost so many weeks the past few years from not being able to exchange it. Then of course they will rent it for you, but you don't get any money for it because they say no one rented your unit. Yet, you call them and they say they have no vacancy for that week. All the rules have changed since we purchased our unit and we all should be able to get out of this nightmare without it ruining our credit rating. They are ripping people off left and right and all these wonderful people now buying in, will also see the light when it is too late. These reps will lie, cheat and steal to talk you into this stuff. I suggest we all file a class action lawsuit against these resorts and file against them at the better business bureau. Whatever it takes to get good people out of these things.

  24. Hi,
We bought a into the whole timeshare spiel in 2001, when I was pregnant. We thought it was a good write off at the time, and with the 2 free Tkts to Kauai that we never got, as well as other "rewards" that we're promised and not delivered, it didn't turn out to be so. We had one week every other year at Pahio Resorts, Kauai Beach Villas. Problem with their great sales pitch, is you still have to have the time off work, the extra cash, and the energy to go. The fees every 2 years were $300, which we paid. Then. After 4 years, they went to $600 every 2 years, and I paid that too. We had already paid the whole timeshare off in 2002 for $10,000, so we were ok. Then, recession hit in 2007, lost our house and 2nd income in 2008. Had health issues, long story, we moved twice, left forwarding addresses, and from 2007 -2014, heard nothing. Now, we are recieving a bunch of legal docs along with about 100 other people in the same boat, wanting maintenance fees yesterday, or they want to foreclose. Just when did the maid fees rise to $1000 every 2 years, and why weren't we ever contacted. Help!

  25. Hi, we purchased a timeshare in 2001. It is located in Kauai, and it' called Kauai Beach Villas at Pahio Resorts. Originally, cleaning fees were $300 every other year. Now, it is almost $1000, which we just found out about within the past few years. We paid over $10,000 overall back in 2002. We continued to pay the maintenance fees. In 2007, it went up to $600, and we paid that too. However, in 2008, we lost our hour due me losing my job. We then moved 2 times, and left forwarding addresses. Trust me, every bill collector on the planet found us except Wyndham? Hmmm. Evidently now, us and a boatload of others are being foreclosed on unless we can cough up back owed cleaning fees? Of, we can just deed it back to them, no harm, no foul. I was just curious if there was any class action suits out there pertaining to this? We haven't heard one peep out of them via mail since. 2007.

She doesn't want it. I called but they said it was too late. We even went to a meeting, we tried to give it back & they said NO and tried to sell us more points. 29. Here is my most recent letter I will be sending on to Wyndham. This is a multiple attempt to get my account canceled. Have not used any points.
    Dear Wyndham, 04/08/14
I will continue to contact this company due to FALSE information until my account has been CANCELED. IF this messes up my Credit Score I will be pursuing legally.
2-16-14 flew into Las Vegas. My first time and boyfriends first time there. I and my boyfriend were approached by 2 men at Harrah’s Hotel near the concierge desk. We were directed that we could receive a free breakfast and 1 of the following FREE deals: 2 tickets for free shows, $100 dinner vouchers or a Visa Card if we were to attend a 1 hour seminar on Wyndham. We signed up to do this for 02-17-14 @ 10 a.m.
2-17-14 we showed up early got checked into the Wyndham Seminar. Was then told that we would do breakfast, seminar and a walk threw one of the locations. We were never told there was a walk through and I wore VERY bad shoes for this LONG walk. We got stuck with an over 4 hour time with Wyndham. This 4 hour block ruined a great majority of our vacation. It took 4 hours due to the Wyndham employees would keep sending us to talk to other people to make a deal. Alyssa was the first one, then her manager, then Wyndham financial and last person was Eric Bradley.
2-18-14 received an email from John M Levasseur with Discovery Sales. Stating he received confirmation etc. (email available). Same day I responded (while on vacation) “I was not aware that we are unable to use all the locations that were in the larger booklet. I'm reviewing the Discovery book and there and very limited locations. Are these the only ones we can vacation as being in the Discovery group?”
2-18-14 2nd email I sent that day said “Also Eric Bradley advised us we can use the points prior to the $1200 and I would like a documented "Yes" on that so we can use it when we would like to. Thank you”
2-19-14 (the day we had to fly home) I received an email back from John M Levasseur but it stated it was Eric Bradley responding with John’s email. He never answered the above question about the locations being different and not being notified of this.
2-23-14 Since I was on vacation and very busy when I got home with my full time job and being sick I responded on 02/23/14 about more inconclusive incorrect information.
2-24-14 emailed stating I wanted to cancel since I received nothing.
2-24-14 emailed again stating I will be mailing the cancelation via postal mail 2-25-14.
I even called and nothing was done. I was on hold for over 20 minutes. Another time I was on hold again and then directed that they cannot proceed due to the account has yet to be activated. I also have faxed over a cancelation request multiple of times.
All I want is to cancel this. I’m not receiving what we were verbally told.
I have already contacted BBB and filed a report. I will continue to file, notify everyone I know, post via social media and an Attorney if needed.

    1. This should be a lesson for anyone seeking to buy a timeshare as this is the way you can expect to be treated after you have sold your soul to the DEVIL! They own you now, and can do anything they want because if you read the fine print, they run the game. I know I got the shaft too. If you signed the papers, then you are the one obligated to fulfill what you agree to they aren't obligated to do anything but leach on to you and suck the life out of you. It's not a good ending, but until we all get together on this and take real control of our lives again instead of crooked timecrap developers and sold out law makers, then it looks like we are in this for the long haul.

  33. Hi there, I am hoping you might be able to help us. We were told we won a competition and went to a Wyndham presentation to collect the prize, once we were in we realised what a scam it was and we eventually managed to escape.
After reading this website we are worried because when we entered they checked out id cards and we 'signed in' then we signed and ticked to decline the offer later, and finally we signed that we received the gift (which we threw in the nearest trash can outside!).
We felt so violated. Is there anything we should be worried about now? can they use our information or signatures to defraud us? We definitely did not sign a contract or credit form or anything but we are still worried. Just hoping for some peace of mind if you can help. Thanks.

They go by the post marked day on the envelope. If bought time share on May 30 then the enveloped needs to be post marked by June 4th in order for it to be legal.

  37. My husband and I were swindled by Wyndham timeshare in San Antonio during our wedding anniversary trip. They gave us the free gifts and everything. Something should have went off when the salesperson mentioned that he use to be an actor. We stayed for the presentation. My husband knowing exactly what they were doing, still was conned. The salesperson lied to us and said that the maintanence fee would be waived because he wanted to do that for "good people". He also mentioned that we would NEVER lose our points it would pile on year after year. It appeared to be a good deal, since I am due this December and wouldn't take a vacation until late next week. After getting home, we looked over the contract and the points do expire. I texted and called about the that and clarification on the maintanence fee being waived, but no response. Unfortunately, when I finally had time to review the contract, it was beyond the six day mark. I am very upset that they would use deceptive practices and have no compassion towards a family expecting a third bundle of joy. I want out!

  42. I'm sad to say that I too was swindled into buying the load of bs Wyndham sold my family. My sister and I joined last May for the sole reason of merging our points with our parent's points to have a larger pool to draw from. As it turns out, the sales rep was extrememly pushy, and lied to our face when she said we could do that without a problem, and lied about many other things such as maintence fees never rising, they said we could use our points anytime, anywhere (which seems to be a problem for everyone in this forum- pay cash on top of your monthly dues) and it seems like payments sprang out of nowhere! We tried to contact her with questions, but never heard back from her. A few months after purchasing the timeshare, we all sat down with a manager at another resort, and asked about cancelling due to being lied to. The woman said, "why would you want to get out of your timeshare?" and proceeded to ignore us and leave the room.
If there is any information out there about legal action againts these monsters, I would like in on it! There has to be some type of legal reprecussions for faulty business practices.
Any advice or help would be great!

  43. My husband and I were also swindled twice by Wyndham. Every previous salesperson lied to us. It was always the last guys fault and they had a new product to get c out of the mess we got into. Most recently, we were told that we had to buy into pathways to be able to pass the timeshare on to another family member and we were coerced into another $105,000 points. We were told that we did not have to pay maintenance fees if we use the Wyndham visa to pay maintenance with points. However once home we calculated that the most you could save is maybe $61 a month, but you would need to charge at least $5k a month to get any results. Maintenance is over $300 a month, help!!

Yep , the maintain fees are 303 dollars a month.

I think most of their condos are 1-2 star ratings at best, but then to add you can never get into them on top of it!! I was in the meeting (Nov 2012), and wasn't too sure about adding more points, but she wanted to do it. Since we now had 1,000,000 points, we would now only pay 50% of the points when booking. That is partially true. We do get 50% off when we book within 60 days of arrival date. Lie #1. Then he proceeded to tell us that with the extra 500,000 points we would be getting, we could pay for a years worth of maintenance. Big lie #2! With the 1,000,000 points I have, I would only have enough to cover 5 months maintenance. I want to sell, but everything I see online looks like a scam too! What are my options??

  49. Stumbled upon this page after doing some research about Wyndham today. Me and my partner got approached at Gold Coast Coolangatta by a friendly chap named Anthony offering discounted tickets to Theme Parks and shows in return for attending a presentation of Wyndham hotel. When we asked him what the presentation is about, Anthony said "just see what the hotel is about, maybe you will want to stay there one day". Discounted $50 show ticket sounded good. We went for that. He had to write down my license number in order to qualify for tickets and he requested we provided $50 cash. We did. Anthony said the tickets will be booked from Wyndham hotel next day upon our arrival to the presentation.
Next day we we went to the presentation at Wyndham in Kirra beach QLD and had to show my drivers license again for a girl at reception to scan. Then a lovely salesman named John greeted us offered us biscuits and coffee and so our conversation with him began. First I had to fill in a one page survey about our travel habits and then presentation began. Some time into the presentation we discovered that John is talking about time share. I had to immediately decline because we do not want to have any commitments, let alone life time commitments. however John insisted on us hearing him out. We did. It sounded all too expensive and there is no way you can make any decisions involving upfront buying $36000 worth of credits plus maintenance fees and a life time So, once more we declined with a polite "No". So as we were heading out of the presentation I was asked to sign one more small paper that had a checkbox saying I have acknowledged receiving the discounted show and this was to ensure that sales staff member could not claim the show ticket for himself.
Now after stumbling upon this blog and experiences people mentioned I am starting to worry. Would my signature or drivers license be used in any illegal way? Should I be concerned?

    1. While you never know the intentions of any individual, as a company Wyndham would not do anything illegal with your information.
That being said, there is a Timeshare Company in Texas where the sales managers were stealing information from clients who had attended the presentation and later sold that information. While this was without the knowledge of the company, you have to ask where trust should be given.
Timeshare sales is fast money and a lot of it. Because these timeshares care more about getting a sale than the integrity of their employees, they sometimes attract less than honest salespeople.

  50. I am interested in any class action lawsuits against Wyndham. I have owned Wyndham properties for 15 years and I am aware of all the deceptions and lies told by the sales persons during presentations. Since I get compensation for rentals of the units which don't cover the maintain cost and those keep going up I would like to join a lawsuit which would compensate me for some of the $456,000 spent on ownership. Rules were changed recently which combines all the ending date of usage into one3 ending date.
This has severely limited the time you can rent the properties much less use them for yourself. (A booking for December 10 with a 60day cancel & rebook window will give you 74 days to rent another resort with the points returned to your account)
Try booking a resort within 74 days!!!
This is only one of the tricks Wyndham cheats owners.
If you have a lawsuit regarding Wyndham pending I would like to join. Please e-mail me at CedricMc77@twc.com!

    1. This is so normal, they get away with this because your contract states "space available" on staying at the resorts. They have your money so they try and grab the public's money then they sell them a timeshare during their stay. I have gotten several people out of their contract because of the lie promising the resorts are for owners only.

  52. We are also the victims of Wyndham lies. Have you noticed that every time you call and complain to Wyndham you start getting calls from companies who want to sell your timeshare. I always ask these companies where they got my information...guess who gave it to them. Wyndham sells our information to these companies...Wyndham is evil!

Since we are "Owners" let's see how they can legally remove us from property..secondly, they should be aware that we will tell others about the fraud and hurt their business. Since we are the ones that suffered financial loss, over and over, they, if they file agasint us, will be forced in court to show their !@@$ BS to the court..We Win..hit me back @northwest_seaside@yahoo.com..Let's get our State AGs to work for us also!

  54. We had been loyal customers of RCI for many years, a few years ago we where told to merge our RCI Timeshares with Wyndham, they said it was going to be a money making opportunity, only a few resorts! And the points system was better and easier to use.
We innocently bought their sales pitch and today we are so sorry we did. We have been paying for nothing, can't hardly use it, and renting them and make profit? Think again - impossible!!!!
Unexpectedly my wife developed a melanoma on her face near her left eye. Four months later I had to have three stents put in my arteries. Since then our financial situation has changed a lot so we decided to call them and ask for a break. We have begged them to give us a break. Have explained that our only source of income is my business in Venezuela, and sadly the political situation there has turned to the worse, and is has became impossible to buy foreign currency (euros, dollars or any other). At this point I can't pay my regular bills, much less vacation resort. I have explained all these them; I have all the proofs, I have written to them begging to take all my three weeks back, the two paid ones and the one that we are still paying. But NOTHING.
I ask anyone that is reading this blog,
    a) if don't have one and you are planning to buy a Timeshare DON'T DO IT.
    b) if you own TS and you feel happy with it, be prepared to be hit with increasing maintenance fees or any other difficulties that will make it difficult for you to use your week.
Please let us unite and stop these vaulters now. They should stop lying, stop making up statistics distorting facts, and make us believe things that are not real and never happen in reality.
These Vaulters should be looked up by the regulatory organizations and forced to clean their sales strategy and forced to stop lying to customers.
If their products are as good as they claim, then why don't they take them back? I have offered to return them for free!
Let's unite and work together to tame this beast.

  55. I have been a RCI member since 2001. I am still on the weeks system which are converted to a value. We have never been able to say "lets go here this year". Always at the mercy of trade. For the past two years nothing has came available for the summer except for the ski resorts stuck in the mountains. Who wants to go to a ski resort in the middle of nowhere in the middle of summer! I find it hard to believe that every beach location in the US is not available during the summer. I think that RCI (a.k.a Wyndham) is selling these out for cash. This has been the worst trading year ever. I am all in for a lawsuit!!!!!

    1. Wyndham/RCI are renting their properties. After 3 years of touring their properties a sales person showed me a foreclosed property in Mrytle Bch. Wyndham purchased. New, Beautiful. OCCUPIED. I asked when can owners book vacation here. Was told mid October when the rentals leave. Confirmed my suspicions as to why it was impossible to book vacations. Nevertheless, I filed bankruptcy the following spring. All too many deceptions and lies.

  61. Agreed that a lawsuit sounds like the only sure way to get rid of the SCAM called Wyndham and RCI. We have already paid in around $50,000 with about $60,000 left to pay. We can't use the points as promised. The Wyndham rental service takes either 60 or 70% and gives us 30-40% - and they do NOT get top dollar for the rentals, so using those "extra" pts to pay the maintenance is bogus.

We just went through what was supposed to be a meeting for Wyndham owners, but turned out to be another company, World Class Getaways. They claimed to be working with Wyndham and RCI to give us options becuase of a previous class lawsuit. Will charge us $13,000 to totally get rid of Wyndham and give us points for RCI. We have found that they do NOT represent or work with either company, and now we are seeing that they might not even be legitimate at all. Not sure if anyone has worked with them. I'm sick of Wyndham and what you CAN'T do with your points. RCI tends to be a ripoff, so when we "bank" our points there it is like throwing them away. Even if it was all paid of, our 770,000 pts are costing us $353 per month for maintenance fees. What a rip-off! That's over $4,200 per year alone! That's 14 days at a $300 per night hotel - and we don't get anything for it! By the way, yes, like others, our loan for the remaining $60,000 is at $14.9%

  62. We are trying to get out of our travel share with Wyndham with no luck. I got an email with a number to call to discuss a possible way to either sell to a third party or to get out of our loan upon them reviewing our contract. I was told we signed a contract and we are bound by it. This contract is for 40 years...Are you kidding me...40 years of paying maintenance fees not to mention the loan with high interest rate...I am glad that they do not have my family's information or they would most likely get them to take over the loan after our passing. I threatened to contact a lawyer as I never even get a statement from them. They said if I requested at the end of the year would receive a statement. That is the only help I received. The only way out is to default on the loan which would ruin my credit. I feel so completely stupid for falling for their sales pitch. We have never had a vacation through them and all we get is a loan payment to make and a maintenance fee to pay every month. For those of you reading this please read what you are signing, better yet walk away if not run. Any information on joining a lawsuit would be appreciated will be contacting an attorney soon.

And the law firm has the wrong interval.. They were furnished with the death certificates that now they conveniently do not have..Where were the bills for all these years? Now because Shawnee has a high default rate the share is significantly diminished.. they are buying back at a low price so they can sell off the condos for full market and still pocket a handsome sum. Now mind you my parents paid $6,000 for 2 weeks 40 years ago.. Now after the promise of the rise in value it is now worth $1,700

  64. My wife and myself vacationed in New Bern NC for our 30th wedding anniversary through RCI. We have owned a timeshare from Wyndham for over 15 years and have used it quite a bit. While in New Bern we went to a brunch and were asked how much are maintenance fees were. We told them and he said they could lower them through a promotion with Barkley credit. My wife was skeptical but I talked her into it since the man keep saying they would be lowered and locked in for 10 years. Well, he came back in the room and said he couldn't lower them but locked them in for just a little more then we were paying now. We signed and when we got home at the end of the week we seen we had bought RCI points and are paying two maintenance fees, one that we were paying before and the new one from them that they put on the credit card with 19% intrest. We have called them several times and they just keep saying we can turn our points in at the beginning of the year to pay for the maintenance fees! (what good is that?) The man lied about the fees and it ruined what was a very nice wedding ann. vacation. My wife called Wyndham yesterday and told them what happened and they sent her to their scam dept. and are suppose to be checking on it. We are going to give them a week or so and then I think we will get a hold of an attorney.

We worked for quite a while to get a reservation at the Ocean Walk Daytona as a wedding gift to our grandaughter. The only requirement we had was we wanted at least an ocean view rooom with a balcony. I called one week before the wedding to verify and was told the unit they were assigned had no balcony and was an inside unit and there wasn't even a window in the unit .Of course there was no recourse. I was told I should have read the fine print on the confirmation. My answer to that is we were very specific when we booked the unit and trusted that they gave us what we wanted. This is not the first time we were treated like this. We have been lied to over and over.We are paid in full but never got our feed because we have to pay a fee to do so. If I knew how to get out of this I would. I was told at one point this will go to our children upon our death. Then mail the letter and all sales material they gave you, including any gift they gave you for being a new owner. This must be sent certified mail and postmarked within the 7 days. They have to refund you per the law.

We hardly use their resorts as it is. Last time I used credits was in Las Vegas where I wiped out 2 years of credits for a suite. I was advised at check in that I needed to attend an owners update meeting. This is a key word for High Stress sales attempt. After they told me that my credits were no good for the newer resorts coming online (after wyndham took over) That I had to buy MORE credits to make my other credits available for use at the new resorts. This is total crud it was sold to us as a normal people being able to enjoy vacation spots that most could not afford. NOW if you don't hold 100,000 plus credits you are restricted to which resorts you can use and when you can use them. Plus credits are going up so what I paid for in 1996 has bottomed out so that I can hardly even use the thing anymore.

  86. Wyndham tricked my husband and I into buying and signing a contract while we had our 4month old baby with us crying and uneasy during a 5hr presentation. They charged me almost $13000 on a Barclay card almost maxing it out telling me I can use this credit card to get rewards points. How am I going to get reward points if I can't use it??? So it seems like Wyndham and Barclay are working together to scam people to buy a fictitious type of property that you can only use with points and also pay maintenance fees and other types of fees because all this company does is charge fees on top of feesWe have been trying to get our contract cancelled for the last 5 months and all they have been telling us is that it's a legally binding contract blah, blah, blah we can't do anything for you but we have a resolution. (what I thought a resolution means your solving my problem not I can't do anything for you). Also to my understanding a legally binding contract can be cancelled or terminated if one party is not able to fulfil it's duties. Meaning I can't pay for it because I can't afford it be cause your sales man told me I would be paying $60 but instead I'm getting charged over $200 monthly which I cannot afford on top of my other bills I have to pay along with other expenses for my child. These people don't have any type of morals they need to be taken down. Now my credit score has gone down because I refuse to pay for points I don't want but didn't realize it until it was too late because the sales people never mentioned that we can recind after a certain amount of days. I don't understand how this corporation still exist. We are now seeking legal help and hopefully we can get out of it. If we all stand together we can fight for all our money back that this multi-million company had stolen from us. If anyone can get me information about getting this cancelled or if anyone can help us pls email me at milleymess@gmail.con

  87. Wyndham Sued For Alleged Financial Fraud Against Senior Citizens
on: June 02, 2017 Print Email
    law
NASHVILLE, TN (JUNE 02, 2017) — A Nashville law firm has filed several lawsuits in Tennessee alleging fraud, breach of contract, and violations of the Tennessee Timeshare Act against Wyndham Vacation Ownership, Inc., the world’s largest timeshare company.

Attorneys Aubrey Givens and Kristin Fecteau have seven lawsuits pending in State and Federal Court in Tennessee, alleging widespread abuse and consumer fraud by Wyndham and its subsidiaries.

Givens said, “We have over 285 senior citizens who are our clients who are alleging financial fraud.”

According to Complaints filed with the court the plaintiffs allege they are victims of fraud, deceptive trade practices, and were not advised of their right to rescind the deal until it went into effect. The allegations say that Wyndham sales people intentionally deceived, misled, and financially injured people who were buying Wyndham timeshares, especially targeting the elderly. Wyndham’s advertising states that in order to attend their sales presentation, prospective buyers must have a minimum annual household income of $60,000. However, there is no such qualification if someone is 55 or older or is fully retired.

The court documents allege that Wyndham engages in all kinds of deceptive tactics, such as selling timeshare points at hugely inflated prices, and failing to go over the information required when closing a real estate transaction as mandated by the Truth In Lending Act.

The lawsuits filed with the court also claim that Wyndham does not disclose that timeshare points are an illiquid asset with no aftermarket, making it difficult if not impossible for people to resell their Wyndham timeshares.

Other allegations included in the court documents state that during the sales process, Wyndham sales agents make numerous intentional or negligent misrepresentations designed by Wyndham to create a false sense of urgency, further pressuring owners to purchase new or additional timeshares.

Additionally, the court documents allege that Wyndham sales agents are intentionally verbally telling people things that are untrue, only to have them sign voluminous, fine-print documents that directly contradict the representations made to them during the sales presentation.

Fecteau said, “If we can make timeshare owners aware of their rights, we can let them know that they have an advocate who will look at their contracts and advise them of their options.”

The four lawsuits pending in Federal Court can be viewed by logging onto PACER, which is the Federal Court online access system.

The Federal cases are: Devine v. Wyndham Worldwide Operations, Inc., et. al, United States District Court for the Middle District of Tennessee, #3:16-cv-02757

Coggins, et. al v. Wyndham Worldwide Operations, Inc., et. al, United States District Court for the Eastern District of Tennessee, #3:16-cv-316

Sanford v. Wyndham Worldwide Operations, Inc., et. al, United States District Court for the Eastern District of Tennessee, #3:17-CV-00036

Two other lawsuits are pending in Chancery Court in Sevier County, Tennessee: Oswald v. Wyndham Worldwide, et al, case #16-11-358, and Urban v. Wyndham Worldwide Operations, Inc., et al., Case # 17-4-121.
